Terms of Agreement


These Terms of Agreement apply to your use of the SummitFlux Platforms, including any products, services, and content we provide through our website summitflux.com ("Platforms"). By using our Platforms, you agree to these Terms and applicable laws. If you disagree with any part of these Terms, please discontinue your use of the Platforms.

SummitFlux LLC ("we," "our," "us") is committed to building a community of users who can interact with our products and services smoothly and responsibly. These terms establish the ground rules for what you can expect from us, as well as your responsibilities as a user.


1. Scope of Application

These Terms cover all products, content, and services ("Content") available through our Platforms. Whether you're browsing, purchasing, or using our services, these rules outline our mutual obligations. Please be aware that certain features may require you to create an account or provide personal information.


2. User Responsibilities

Our Platforms are designed for personal use, and by accessing them, you agree to:

  • Use the content and services for non-commercial purposes only.
  • Ensure that your use complies with all applicable laws and does not infringe on the rights of others.
  • Respect the rights, property, and safety of others when interacting with us or other users of our Platforms.
  • When contributing any content (comments, reviews, images), you agree not to post anything harmful, offensive, or that violates these terms or the rights of others.


3. Creating an Account

To fully access some features of our Platforms, you may be required to create a SummitFlux account. You are responsible for safeguarding your account credentials, and any activity on your account will be deemed as your own. If you suspect unauthorized access, please notify us immediately.


4. Order and Purchase Terms

By placing an order through the SummitFlux Platforms, you are offering to purchase products under these Terms. Orders must be accepted by us before they become binding. We reserve the right to decline any order that appears abnormal or made in bad faith.

Once your order is processed, we will send you an email confirmation. Until this confirmation is received, no contract of sale has been formed.

Please ensure that the details you provide are accurate, including shipping addresses, payment details, and any additional information requested during the order process.


5. Prices, Shipping, and Availability

All prices for products are listed on the order confirmation email. Prices may change at any time, but adjustments will only apply to future orders. Separate charges for taxes and shipping will be displayed in your shopping cart and included in the order confirmation.

We aim to deliver your items within the specified timeframe, but availability is not guaranteed. In rare cases, product delays or discontinuations may occur. If a product becomes unavailable after your order is placed, we will notify you and provide a refund or alternative option.


6. Returns, Refunds, and Exchanges

SummitFlux is committed to providing high-quality products designed for backcountry use. We want you to feel 100% confident in your purchase. Therefore, we offer a 180-day hassle-free return policy to ensure your satisfaction.

Returns & Refunds

  • 180-Day No-Questions-Asked Guarantee: Customers may return any SummitFlux product within 180 days of the delivery date for a full refund or exchange, no questions asked.
  • Returns After 180 Days: If more than 180 days have passed since delivery, please contact us at [email protected]. We understand that some customers may purchase gear in the off-season and not have a chance to test it right away. While we cannot guarantee refunds past this period, we will work with customers on a case-by-case basis to find a suitable solution.
  • Refund Method: Refunds will be processed to the original payment method unless otherwise requested. If you need your refund issued via a different payment method, please notify us in advance.
  • Condition of Returned Items: While we accept returns of used products within the return period, items should be in functional condition (aka, if you ran it over with a snowmobile, we might have to chat first). If an item is excessively damaged or modified beyond standard wear and tear, SummitFlux reserves the right to decline the return.
  • Processing Time: Refunds and exchanges will be processed within 3-5 business days after the returned item is received.

How to Initiate a Return

To initiate a return, customers must:

  1. Contact us at [email protected] with their order number and request.
  2. Ship the item back using a return label provided by SummitFlux (if applicable).
  3. Receive a refund or exchange upon processing of the returned item.

7. Intellectual Property

All content and materials on the SummitFlux Platforms are the exclusive property of SummitFlux or licensed to us by third parties. This includes text, logos, graphics, product designs, and other materials. You may not copy, modify, or distribute any of this content without prior written permission from us.

We grant you a limited, non-exclusive license to use our content strictly for personal, non-commercial purposes. This license does not allow for the reproduction or modification of our content for any unauthorized use. Any unauthorized use of SummitFlux materials will result in immediate termination of your access to our Platforms.


8. Limitation of Liability

SummitFlux is not responsible for any direct, indirect, incidental, or consequential damages that may result from your use of our Platforms, products, or services. This includes, but is not limited to, damages arising from errors, delays, or interruptions in service, loss of data, or failure of any product to meet your expectations.


9. Privacy and Data Protection

By using our Platforms, you agree to our privacy practices outlined in the SummitFlux Privacy Policy. Your data will be used to process orders, improve services, and communicate with you. We take the security of your data seriously and implement appropriate measures to safeguard your information.


10. Governing Law

These Terms of Agreement will be governed by and interpreted in accordance with the laws of the state of California, without regard to its conflict of law principles. Any legal disputes arising under these Terms will be resolved in the courts located in California.


11. Amendments to These Terms

SummitFlux reserves the right to update or modify these Terms at any time. Changes will take effect from the date they are posted on our website. By continuing to use our Platforms after any changes are made, you accept and agree to be bound by the updated Terms.
